Important: Preparing For Your Legal Surgery

We are currently experiencing booking problems with our system: please email hello@courtwingman.com to book a surgery while the site is being updated. We will send you bank details for transfer of £150.

Please note that we will not read papers before the surgery, but we will peruse key documents, as requested, during the call. We prefer Skype, which is reliable and easy to use and best for two person meetings. It is also easy to share the screen. We will send you a link so you do not have to download it to your computer. (Skype now works like Zoom. If you prefer Zoom, then send us a link prior to the call.)

Best practice is to send us a short email laying out the story of the case in one or two short paragraphs, and any key documents attached as a single PDF in chronological order. This is the very best preparation for the call. Civil litigation is about the proper preparation of documents. Judges are extremely busy and the more concise your pleadings, statements and case summary documents, the more likely they are to be read - and so more likely the judge will favour your case!

If any problems, simply email us at hello@courtwingman. We will be happy to take you through the process.

A one-hour legal surgery is for general advice on your case to give you proper pointers on the next steps. We can look at documents together during the call. Please email hello@courtwingman.com with you preferred time of appointment.

A one-hour legal surgery is usually the best starting point for most queries. If you email us a paragraph or two of the story of your case this will help. Also provide us with key documentation as a PDF, particularly for cases which are issued at court and where there are court orders and statements of case. If your case has not reached the courts, a letter of claim and a response to a letter of claim will help.

We prefer Skype, which is reliable and easy to use and best for two person meetings. It is also easy to share the screen and look at documents. We will send you a link so you do not have to download it to your computer. (Skype now works like Zoom. If you prefer Zoom, then send us a link prior to the call.)

Paperwork!

Civil litigation is about the proper preparation of documents, whether for a legal surgery, preliminary review or for your case generally. Judges are extremely busy and the more concise your paperwork is, the more likely they are to be read – and so more likely the judge will favour your case! Managing paperwork is key in litigation and arguably even more important than the strengths and weaknesses of the case. Everything is decided on the paperwork these days, not in flowery speeches and advocacy in front of judges. It’s not enough to have a strong claim, you also need to present the paperwork properly.

For advice on how to prepare your paperwork, for both the legal surgery and for your case generally (you might want to scroll to 2 minutes in):

                                       https://youtu.be/NhpGe874BJw

During the surgery will focus on giving you concrete advice on next steps. With Courtwingman you are getting affordable advice and not having to sign a complex retainer with a law firm and put large amounts of money on account just to get started. Law firms have high overheads, with a lot of red-tape and big insurance premiums and they are not so good as a “one-stop shop”.

With us you just pay the fixed fee, check our terms and conditions, and receive the advice.

One of the most important things you will gain from a surgery is, simply put, a proper perspective on your case and, critically, advice on procedure. Civil litigation in the county courts can be notoriously complex, even for smaller cases, and we can help you navigate around the Civil Procedure Rules. We are working on cases every day, and know how to deal with the courts. We can help you with the value of your claim and how to properly particularise losses – and so avoid your claim being struck out. Or advise you how to strike out an opponent’s case!

One the most important areas of advice is to tell you if your case is commercially viable. Too many litigants in person pursue weak claims, or low value claims, that should really be settled early, or even dropped altogether. So we will give you the “tough love” here, too and not encourage you to pursue a lost cause.

One of our solicitors will get in touch with you to confirm we’re good to go ahead;

We meet on Skype, Zoom or telephone to discuss your case and the next steps. Documentation can be read during the call, or draft letters or pleadings reviewed.

Important: Have legal proceedings commenced?

If you are already in court it is often better to obtain a proper preliminary review before a legal surgery, as it is often difficult to give any really useful advice without having perused the paperwork. If you send us the email and documents we can estimate the cost of this before you proceed.

Please be aware that it is a fact of life that there is a lot of reading at the beginning of a case in order to get to grips with the case. But the costs of our service afterwards, on a “top up” basis, should not be so expensive. (You may later need to drop in for advice on various key stages.)

Are you representing yourself in a county court of England and Wales… or plan to? Civil proceedings are more often than not like an aerial dogfight, for which you had no training. Your opponent may fire ammunition you didn’t know existed and get the help you cannot afford. Is it like riding a bike? No. If it was easy, lawyers wouldn’t exist. To put the odds of winning in your favour you need guidance from someone who can navigate the rarefied atmosphere and teach you controls.

About the author

Alex Woods is a solicitor and litigation specialist with over 25 years of experience in the courts of England and Wales. Since he runs a law firm, he deals daily with all sorts of general litigation, whether representing clients in the courts himself or giving people advice and assistance over the phone when they run their case themselves, just as you may be about to.

Cases that he has worked on include building disputes (acting for both business and individuals), negligence disputes between neighbours, professional negligence (accountants and solicitors), financial mis-selling litigation (suing banks), contractual disputes, landlord and tenant, personal injury, small-scale commercial disputes, cohabitation property disputes, contested will disputes and inheritance act claims. One new area in which Redwood Legal now provides access to justice is representing foreign businesses against UK-based opponents who are trying to use cross-border issues to evade debts.

He passionately believes in access to justice, ever since he came up against the problem of large, rich businesses and corporations who intimidate opponents with the cost of legal proceedings. He first came across this as a young lawyer whilst working for his father’s small business in Colchester, Essex, involving a dispute with a well-known construction company. This is why he also runs a YouTube channel providing people with advice and assistance on running their claims. More recently, it created the CourtWingman (dot ) com website.

Sometimes clients do not need full representation and just rely on the free materials or and the odd phone call. Alex Woods likes nothing more than when people are able to run their claims with minimal help. One recent example is a follower who had been faithfully following the free materials on YouTube and had written a long thank-you note, attaching the actual copy of the judgment that had been made in his favour! He had won without paying a penny to lawyers.

Before establishing Court Wingman and the law firm, Alex Woods was passionate about financial mis-selling and represented many clients against the banks at the time of the 2008 recession (payment protection insurance and interest rate swaps). He appeared on BBC’s popular daytime television show with Angela Rippon, Julia Somerville and Gloria Hunniford, “Rip Off Britain!”.

There are many occasions when a one-hour legal surgery is simply not enough to give you the help you need. For example:

Do you need a lawyer to review the documents in your case and so give you a proper advice on the merits and the quantum?

Do you need help drafting documents such as a particulars of claim, defence, witness statment, or letter before action?

Do you want a lawyer to review documents that you yourself have drafted?

Do you need to know how to make an application, and use the N244 form?

Do you need specialist advice from a barrister?

Do you want help completing disclosure or interpreting a court order?

Do you need to amend your claim?

Do you not understand what costs budgeting and Precedent H’s are?

Do you need someone to help you at trial?

Have you been faced with a strike-out application, or worse, a costs order against you, and do not know what to do?

In all the above cases, and many more, we’re at your service! At affordable cost. If you do not know whether we can help – email us: The hello@courtwingman.com inbox is checked by our solicitors almost every day.

Civil litigation is about the proper preparation of documents, whether for a legal surgery, preliminary review or for your case generally. Judges are extremely busy and the more concise your paperwork is, the more likely they are to be read – and so more likely the judge will favour your case! Managing paperwork is key in litigation (and arguably even more important than the strengths and weaknesses of the case). Everything is decided on the paperwork these days, not in flowery speeches and advocacy in front of judges. It’s not enough to have a strong claim, you also need to present the paperwork properly.

For advice on how to prepare your paperwork, for both the legal surgery and for your case generally, go to (you might want to scroll to 2 minutes in):

Do I do this before or after a Legal Surgery?

This service may include a one-hour legal surgery, where we will discuss and review your case. This is because, only after the initial one-hour legal surgery is done, will your dedicated solicitor-advisor know what is required and will normally be able to quote the cost. But in some cases, for instance if you are already in court and there are pleadings and court orders, it will be difficult ot do justice to your case without having read the papers first.

How much will it all cost?

Drafting pleadings is obviously at the high end, sometimes as much as £1,500 or £2,000+. Writing a simple letter or making a simple application may obviously be nearer the lower end, £300. Send us the documentation so we can properly estimate before you spend any money.

As such, please do not use this page for payment unless instructed to do so. Email hello@courwingman.com and then send us your documents for an accurate quote.
