Important: Preparing For Your Legal Surgery

Please note that we will not read papers before the surgery, but we will peruse key documents, as requested, during the call. We prefer Skype, which is reliable and easy to use and best for two person meetings. It is also easy to share the screen. We will send you a link so you do not have to download it to your computer. (Skype now works like Zoom. If you prefer Zoom, then send us a link prior to the call.)

Best practice is to send us a short email laying out the story of the case in one or two short paragraphs, and any key documents attached as a single PDF in chronological order. This is the very best preparation for the call. Civil litigation is about the proper preparation of documents. Judges are extremely busy and the more concise your pleadings, statements and case summary documents, the more likely they are to be read – and so more likely the judge will favour your case!

A one-hour legal surgery is usually the best starting point for most queries. If you email us a paragraph or two of the story of your case this will help. Also provide us with key documentation as a PDF, particularly for cases which are issued at court and where there are court orders and statements of case. If your case has not reached the courts, a letter of claim and a response to a letter of claim will help.

Paperwork!

Civil litigation is about the proper preparation of documents, whether for a legal surgery, preliminary review or for your case generally. Judges are extremely busy and the more concise your paperwork is, the more likely they are to be read – and so more likely the judge will favour your case! Managing paperwork is key in litigation and arguably even more important than the strengths and weaknesses of the case. Everything is decided on the paperwork these days, not in flowery speeches and advocacy in front of judges. It’s not enough to have a strong claim, you also need to present the paperwork properly.

During the surgery will focus on giving you concrete advice on next steps. One of the most important things you will gain from a surgery is, simply put, a proper perspective on your case and, critically, advice on procedure. Civil litigation in the county courts can be notoriously complex, even for smaller cases, and we can help you navigate around the Civil Procedure Rules. We are working on cases every day, and know how to deal with the courts. We can help you with the value of your claim and how to properly particularise losses – and so avoid your claim being struck out. Or advise you how to strike out an opponent’s case!

One the most important areas of advice is to tell you if your case is commercially viable. Too many litigants in person pursue weak claims, or low value claims, that should really be settled early, or even dropped altogether. So we will give you the “tough love” here, too and not encourage you to pursue a lost cause.

THE PROCESS
  1. Email hello@courtwingman.com for an appointment, with a pargraph or two if needed, and then send key documents to hello@courtwingman.com (preferably as a single PDF file with documents in reverse chronological order. Watch video in link above);
  2. One of our solicitors will get in touch with you to confirm we’re good to go ahead;
  3. We meet on Skype, Zoom or telephone to discuss your case and the next steps. Documentation can be read during the call, or draft letters or pleadings reviewed.

Important: Have legal proceedings commenced?

If you are already in court it is often better to obtain a proper preliminary review before a legal surgery, as it is often difficult to give any really useful advice without having perused the paperwork. If you send us the email and documents we can estimate the cost of this before you proceed. 

Please be aware that it is a fact of life that there is a lot of reading at the beginning of a case in order to get to grips with the case. But the costs of our service afterwards, on a “top up” basis, should not be so expensive. (You may later need to drop in for advice on various key stages.)
